​The Kentucky Department for Environmental Protection has certified, denied, or conditioned the 2012 re-issued and issued U.S. Army Corps of Engineer’s nationwide permits. These water quality certifications have an effective date of March 19, 2012.

Activities authorized under a valid USACE nationwide permit and previously qualifying for a general water quality certification that were under construction or under contract to begin construction prior to March 18, 2012, shall have until March 19, 2013 to complete construction under the 2007 general certification conditions.

​Effective November 15, 2012, by order of the Director, if a utility line project qualifies for a general certification of NWP 12 and is within 50 feet of the stream bank, a WQC application and a site-specific sediment and erosion control plan must be submitted for review and approval by WQC before construction and construction-related activities can proceed.   This is in addition to the Stormwater Pollution Prevention Plans for construction sites one (1) acre or more in size.  Please see the guidance document entitled Water Quality General Certification of Utility Line Activities Along Streams under the Quick Links for General Water Quality Certification of Nationwide Permits and Supporting Documents and Guidelines.
